LAMOURE, N.D. (KVRR) — A North Dakota farmer is suing the federal government for violating the terms of a wetlands easement from years ago.
Attorneys for Cody Peterson filed the lawsuit in April, claiming that the decades-old easement is not specific to the areas and labels small depressions as part of a wetland. Peterson says the Fish and Wildlife Service map has prevented him from farming nearly half of his farmland.
Pacific Legal Foundation has been working with Peterson, and has heard of dozens of other farmers from Minnesota to South Dakota who’ve had similar issues and have had charges filed against them.
Jeff McCoy, Pacific Legal Foundation, says, “We just want the federal government to recognize what actually the agreement was. And not to expand the meaning of those contracts and those agreements.”
Pacific Legal Foundation is representing Peterson for free, and hopes action will be taken in the next month.
